Livstyle Visual Personality Portrait Terms of Service

These Terms of Service apply to all the versions of the Livstyle Visual Personality Portraits and the related tools including Workstyle, Youthstyle, Ministrystyle, Ministrystyle for Youth, Marriagestyle.

1. Your relationship with Livstyle Visual Personality Portraits

1.1 The Universal Terms, together with the Additional Terms, form a legally binding agreement between you and Livstyle in relation to your use of the Information Services. It is important that you take the time to read them carefully. Collectively, this legal agreement is referred to below as the "Terms".

2. Accepting the Terms of Livstyle

2.1 In order to use the Livstyle information services, you must first agree to the Terms. You may not use the Livstyle information services if you do not accept the Terms.

2.2 You can accept the Livstyle Terms by:

(a) Clicking to accept or agree to the Terms, where this option is made available to you by Livstyle in the user interface for any Service; or

(b) By actually using the Livstyle Visual Personal Portraits. In this case, you understand and agree that Livstyle will treat your use of the Services as acceptance of the Terms from that point onwards for the full agreed upon contract period or number of scorings purchased.

3. Provision of the Services by Livstyle Visual Personality Portraits

3.1 Livstyle Visual Personality Portrait is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Livstyle information services may change with new version updates.  

3.2 You acknowledge and agree that if Livstyle disables access to your account due to failure to make payment, violation of the contractual agreement or abuse of private information, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.

4. Use of the Services by an individual, company or organization

4.1 You (an individual, company or organization) agree to use the Livstyle information services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines of confidentiality in the relevant jurisdictions (including any laws regarding the export of data to and from the United States or other relevant countries).

4.2 Unless you (an individual, company or organization) have been specifically permitted to do so in a separate agreement with Livstyle, you agree that you will not violate copyright laws by using Livstyle data to produce reports and training materials not generated by Livstyle.

4.3 You (an individual, company or organization) agree that you are solely responsible for, that Livstyle has no responsibility to you or to any third party for, any breach of your obligations of confidentiality regarding any information that your company, organization or you as an individual have access to you have privileged access to confidential information as a representative of your respective organizational account.

 

5. License for an Organization with Livstyle

5.1 When a company or organization enters into a license agreement to use any of the Livstyle tools it is for the sole purpose of enabling the organization or company to benefit from the Livstyle information services in the manner permitted by the terms of the specific agreement. The various agreements are available on the website with the exception of a Partnership agreement.

5.2 A company, organization or individual cannot modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Livstyle tools unless specific permission is granted by Livstyle.

6. Ending your relationship with Livstyle as an organization

6.1 The Terms will continue to apply until a contract period has been completed. The full financial obligation of the contract period must be met in order to terminate a contact prematurely.

6.2 If the contractual relationship is ended, to enter into a contractual arrangement with Livstyle in the future will include the initial start-up fee.

6.3 Upon termination of the contract with Livstyle an organization will no longer have access to portraits nor the training materials.

6.2 Livstyle may at any time, terminate its legal agreement with you if:

(a) You (an individual, company or organization) have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or

(b) Livstyle is required to do so by law (for example, where the provision of the services to you is, or becomes, unlawful).

7. Privacy and your personal information

7.1 For information about Livstyle's data protection practices, Livstyle treats your personal information, and protects your privacy, when you use the Livstyle tools and information services. We give the information contained in Livstyle Visual Personality Portraits only to companies and other individuals that you authorize. We do not sell your information, and we do not provide it to those who would use the information to market their products to you. From time to time, our research means that we will include personality information, but not personal information (name, addresses, phone info, etc). The data is used as part of the large group to examine trends, tendencies, etc.

7.2 When a company or organization asks you to do your Visual Personality Portrait, you are agreeing to let them view your portrait report. Your company or organization shares a similar responsibility to safeguard personal and confidential information.

7.3 You understand that all confidential information under an organization's account which you may have access to as part of that company or organization are the sole responsibility of the person representing

8. Proprietary rights

8.1 You acknowledge and agree that Livstyle owns all legal right, copyright, title and interest in and to the services, including any intellectual property rights which subsist in the Livstyle tool information and website training information. Information can be reproduced only for the purpose of Livstyle training and not to be used as information for the personality tools of other companies. You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trade mark notices) which may be affixed to or contained within the Livstyle copyrighted materials.

8.2 Unless you have been expressly authorized to do so in writing by Livstyle, you agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.

9. LIMITATION OF LIABILITY

9.1 YOU EXPRESSLY UNDERSTAND AND AGREE THAT LIVSTYLE, ITS AFFILIATES, AND ITS LICENSORS SHALL NOT BE LIABLE TO YOUR INDIVIDUAL AND ORGANIZATIONAL ACTIONS FOR:

(a) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, ANY VIOLATION OF CONFIDENTIALITY, ANY LOSS OF GOODWILL OR BUSINESS REPUTATION.

(b) YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.
